That said, to maximise the chance of the client being offered quotes, we recommend an application be made as soon as possible but after you have undertaken an initial investigation and believe the case has good prospects of success. Payment of the Premium

The majority of quotations obtained for Personal Injury Litigation through The Judge offer deferred premium terms.  Furthermore most quotations received through The Judge are self-insured or conditional-upon-success which means that client does not have to pay a premium if the case loses.

Does the instructed solicitor have to act under a CFA to obtain ATE insurance for a one-off case?

Unlike some other non-injury areas of law, unless the case is particularly high value, the majority of ATE insurers are unlikely to consider offering insurance where the solicitor is not prepared to enter a Conditional Fee Arrangement.

Psychological Injury (Bullying and Occupational Stress) Cases

A positive advice from Counsel is usually a requirement for underwriters before submitting an application for this type of  insurance.

Group Actions

Sourcing cover for group litigation is a specialist business and it is even more important that you approach an independent broker familiar with what the ATE market can offer before embarking on a long and complicated search for cover. It is often the case that the need for suitable ATE cover is matched by an equally important requirement for disbursement funding. We will consider all aspects before a search for insurance is made.
