Does the instructed solicitor have to act under a CFA to obtain ATE insurance for a one-off case?
Unlike some other non-injury areas of law, unless the case is particularly high value, the majority of ATE insurers are unlikely to consider offering insurance where the solicitor is not prepared to enter a Conditional Fee Arrangement.
