The Judge recognises that the issues of funding and After-The-Event insurance are interlinked. This is because of two reasons:
- Whether or not they would be offered ATE insurance, individual claimants are often unable to pursue their claims, due to a lack of funds.
- Reputable funders are not prepared to offer loans without a reputable insurance policy in place to cover the cost of the loan in the event the case loses.
As a result, The Judge has relationships with disbursement funders who are ready to provide loans to both solicitor firms and clients in order to fund interim disbursements in both injury cases and non-injury cases.
Personal Injury and Clinical Negligence
Fast-Track Personal Injury lending
Disbursement funding for Fast Track cases is usually provided by way of a Consumer Credit Act loan in conjunction with a reputable ATE insurance scheme. Funding for the insurance premium is also available if required.
Multi-Track Personal Injury and Clinical Negligence lending
Funding for large value cases is less common than funding for Fast Track cases. However, funding is available for such cases on a Practice Lending basis.
An example of the type of funding that may be available is:
- Practice lending to a maximum of £500,000. There are no CCA agreements
- Element of 'Work In Progress' funding
- No set up charges for the loan
- No under-utilisation fees
- Loans that run for 36 months with the option for a further 24 month
extension
- Max facility of £50,000 per case
- The responsibility for the loan is with the firm regardless of the insurance
position
- Interest Rates are tailored to the firm and bespoke quotations are available upon
request Guideline information on the amount the firm intends to borrow may be
required
Please note that lending is provided on a volume basis and not offered on individual cases. As a result, funding facilities need to be considered in the context of a tailored ATE arrangement which the funder is prepared to accept as adequate to insure the sums loaned. Individual High Value Commercial cases
Contingency Funding - for individual cases only. The value of the claim must be high and the costs that require funding must be over £70,000. This is a type of funding arrangement where an element of the award successfully received from the opponent is shared with the funder. Please contact us for more details.
