Most litigation insurers offer premiums on a deferred and contingent basis as standard. Guaranteed top-up policies are also perfectly feasible, where the cover is not unlimited. However, interim funding, cover for applications for injunctive relief both in the UK and abroad and retrospective cover for investigation costs are less readily available. Security for costs applications can also create a hurdle which can be insurmountable once the litigation has commenced.
