Business Recovery and Insolvency Litigation

At TheJudge, we have relationships with all of the leading ATE Insurers and Third Party Funders that offer litigation risk sharing solutions in insolvency litigation. With the number of companies facing financial distress on the increase in the current economic downturn, creditors will increasingly look to the Insolvency Practitioner and their lawyers to take action to protect or recover their money.  Our skilled independent broking team are on hand to offer Insolvency Practitioners a new era of product development, with genuinely impartial advice and guidance.

Our focus is on innovation in the insolvency sector, as some products in the market have historically not entirely met the needs of the Insolvency Practitioner. Because we work with all the leading litigation insurers and litigation funders, we know what can be achieved and we are all too aware that underwriters will rarely offer their best terms unless pushed.

Most litigation insurers offer premiums on a deferred and contingent basis as standard. Guaranteed top-up policies are also perfectly feasible, where the cover is not unlimited. However, interim funding, cover for applications for injunctive relief both in the UK and abroad and retrospective cover for investigation costs are less readily available. Security for costs applications can also create a hurdle which can be insurmountable once the litigation has commenced. TheJudge are in a unique position to work with the Insolvency Practitioner and their lawyers to move quickly to overcome these hurdles as and when they arise.

At TheJudge we look to obtain complete protection for the Insolvency Practitioner and their lawyers from investigation to enforcement in order to ensure that the burden of pursuing litigation is not entirely theirs to bear.
