Legal Expenses Insurance and ATE Insurance
Legal expenses insurance, also known as legal protection insurance, after the event insurance or ATE insurance is designed to cover the insured against their legal costs exposure of pursuing or defending a legal dispute. There are two forms of legal protection insurance - before the event and after the event insurance, with 'the event' serving as the scenario which has triggered legal action.
After the event insurance, or ATE insurance, is taken out to ensure that the policyholder is protected against legal costs incurred after an event has occurred e.g. an investor suffers financial loss following negligence financial advice, the ATE policy will indemnify the client for some or all of their legal costs in pursuing their claim against the financial advisor/institution. The legal expenses insurance company enlisted will pay the opponent's legal costs (adverse costs) should the policyholder's case be unsuccessful but will also potentially insure the insured's own expenses and lawyer's fees. Unlike before the event (BTE) insurance, in England and Wales the premium charged for ATE insurance is a recoverable cost from the losing side. Solicitors in England and Wales are obligated under their Code of Conduct to discuss the availability of BTE insurance, ATE insurance and litigation funding with all clients contemplating legal proceedings.

This means the litigant does not have to pay the litigation funder back if the case is unsuccessful.

Third party funders finance the client's legal costs as the case progresses and typically against an agreed cost budget. In return for the risk they’ve taken the funder is paid a success fee if the case is successful.
Success fees payable to litigation funding companies can vary enormously. TheJudge is accustomed to sourcing highly competitive terms from the marketplace and we have ample case examples of where we've saved clients millions by prudently selecting competitive litigation finance terms. Lawyers must be cautious when advising clients on litigation funding options. If the lawyer is not able to gauge what are competitive litigation funding terms they could run the risk of a future negligence claim by the client e.g. if the client ends up paying substantially more than they needed to.
To secure funding most litigation funders will need to be convinced there are good prospects of the case being successful with a strong likelihood of being able to successfully enforce an award i.e. the opponent must be credit worthy.
